Resolution No. 6-12-19-14 RESOLUTION OF THE GREAT PLAINS TRIBAL CHAIRMAN’S ASSOCIATION

A RESOLUTION OF THE GREAT PLAINS TRIBAL CHAIRMAN’S ASSOCIATION OFFICIALLY SUPPORTING THE OCETI SAKOWIN EDUCATION COMMISSION CALL UPON THE ASSISTANT SECRETARY FOR INDIAN AFFAIRS TO DIRECT THE DEPUTY ASSISTANT SECRETARY FOR MANAGEMENT TO RESTORE THE $3,123,000 FOR FORWARD FUNDED EDUCATION PROGRAMS AND TO FULLY FUND TEACHER PAY COSTS IN FY 2014 AT THE NEEDED LEVEL OF $2,954,000

 

WHEREAS, the Great Plains Tribal Chairman’s Association (hereafter GPTCA) is composed of the elected Chairs and Presidents of the federally recognized sovereign Indian Tribes and Nations within the Great Plains Region of the Bureau of Indian Affairs; and

 

WHEREAS, the Great Plains Tribal Chairman’s Association is formed to promote the common interest of the Sovereign Tribes and Nations who are members of the GPTCA; and

 

WHEREAS, the United States has obligated itself to ensure the well-being of sovereign Tribes and Nations of the Great Plains Region both through Treaties and federal statutes, including the Snyder Act of 1921 ad amended, the Indian Self-Determination Act of 1976 as amended, and the Indian Health Care Improvement Act of 1976 as amended, and

 

WHEREAS, the GPTCA recognizes its responsibility to act to advance the goals of the Tribes and their members and to promote improvements to the health, safety welfare, education, economic development and preservation of the spiritual, cultural, and natural resources of its member Tribes and Nations; and

 

WHEREAS, The Congress appropriated $591,234,000 for “forward funded education programs” in the FY 2014 interior Appropriations Act (128 Stat.300) and specified the same amount in the FY 2014 conference report for forward funded elementary and secondary programs and forward funded Post Secondary Programs (Congressional Record, January 15, 2014, page H975); and

 

WHEREAS, The Indian Affairs FY 2014 budget justification contained a request of $3,834,000 for Teacher Pay costs (IA-ST-7); and

 

WHEREAS, The Indian Affairs FY 2014 operating plan provided only $588,111,000 for forward funded education programs, a reduction of $3,123,000 (-0.5%) from the amount appropriated by the Congress; and

 

WHEREAS, The Indian Affairs FY 2014 operating plan provided only $169,000 for Teacher Pay costs, a reduction of $2,954,000 (-94.6%) from the amount needed; and

 

WHEREAS, The Bureau of Indian Education (BIE) funded schools will absorb the cost for Teacher Pay in FY 2014 (school year 2014-2015) unless the funds are restored; NOW

 

THEREFORE BE IT RESOLVED, That the Oceti Sakowin Education Commission calls upon the Assistant Secretary for Indian Affairs to direct the Deputy Assistant Secretary for Management to restore the $3,123,000 for forward funded education programs and to fully fund Teacher Pay costs in FY 2014 at the needed level of $2,954,000; and

 

BE IT FURTHER RESOLVED, That the Oceti Sakowin Education Commission calls upon the Assistant Secretary for Indian Affairs to direct the Deputy Assistant Secretary for Management to allocate the full amount of funding appropriated by the Congress in the FY 2015 appropriations bill for forward funded education programs in the FY 2015 Indian Affairs operating plan; and

 

BE IT FINALLY RESOLVED, The GPTCA will adopt this Resolution and submit to the Secretary of the Interior.

This resolution was enacted at a duly called meeting of the Great Plains Tribal Chairman's Association held at Rapid City, South Dakota on December 19, 2014 at which a quorum was present, with 9 members voting in favor, 0 members not abstaining, and 7 members not present.
